Right of Withdrawal

Have you booked a paid service from us – a consultation, an online seminar or a relocation service, for example? And was the contract concluded only through this website, by email, by telephone or through a messenger service? Then you can withdraw from the contract within 14 days. You do not have to give a reason.

You have this right as a consumer. A consumer is any natural person who concludes a contract for private purposes – that is, not for their own trade and not for a self-employed professional activity (§ 13 BGB). Companies, associations and public authorities do not have this right of withdrawal.

Important for consultations: your right of withdrawal can expire early. This is explained below in the section “When your right of withdrawal expires early”. Please read that section before you book an appointment.

The following text is the information required by law. It is reproduced in its official wording.

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day of the conclusion of the contract.

To exercise your right of withdrawal, you must inform us (Björn Strenge, Birkenstraße 12, 26419 Schortens, Germany, telephone: +49 4461 8999971, email: info@migranten-hilfe.de) of your decision to withdraw from this contract by means of a clear statement (for example a letter sent by post or an email). You may use the attached model withdrawal form for this purpose, but it is not obligatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

If you requested that the services should begin during the withdrawal period, you shall pay us an amount which is in proportion to what has been provided until you have communicated to us your withdrawal from this contract, in comparison with the full coverage of the contract.

When your right of withdrawal expires early

This section is an explanation in plain language. It is not part of the official model text.

A consultation is often over before the 14 days have passed. For this case the law says: the right of withdrawal can expire early (§ 356 Absatz 4 BGB). For that to happen, all three points must apply together:

If even one of these points is missing, your right of withdrawal remains. In particular, your right of withdrawal does not expire simply because you have already paid. A payment is not a waiver of the right of withdrawal.

So that you can make this decision consciously, we ask you about it expressly when you book a consultation appointment. You tick a box there and thereby declare both things: that you want us to start early, and that you know you may lose your right of withdrawal. We store this declaration together with your booking.

So as long as the consultation has not yet been carried out in full, you can withdraw – even after payment. Once the consultation has been carried out in full, withdrawal is no longer possible, and there is then no refund. The same applies once the 14 days have passed.

Compensation for value if the consultation has already begun

This section is an explanation in plain language. It is not part of the official model text.

You asked us to start immediately and then withdraw in the middle of the service? In that case you will not get all of your money back. You pay a reasonable share for what has already been provided up to the withdrawal (§ 357 Absatz 8 BGB). The law calls this share “Wertersatz” (compensation for value).

An example: you booked a consultation of 60 minutes for 99,00 € and expressly asked us to begin immediately. After 30 minutes you break off and withdraw. We then keep roughly half of the price as compensation for value and refund you the rest.

You owe compensation for value only if we informed you about the right of withdrawal before the booking and you expressly asked for an early start. If either of these is missing, you pay nothing.

As long as we have not yet begun, you will of course receive the full amount back if you withdraw.

Model withdrawal form

You do not have to use this form. An informal, clear statement by email or letter is enough. If you wish, you can copy the following text and send it to us.
