1. Scope and extent

Björn Strenge provides paid consultation services in the fields of migration, relocation and work for private individuals and organisations. He also provides free information through the website https://migranten-hilfe.de and through his profiles on social networks.

These general terms and conditions apply to all business relationships in connection with the migration and career consultation provided by Björn Strenge (contracts, consultations, events, digital products and similar) with private individuals and organisations – hereinafter referred to as the “client” – unless their application has been expressly excluded.

For organisations the following applies: if the organisation uses its own general terms and conditions that differ from or add to these, their application is hereby rejected. They only become part of the contract if Björn Strenge has expressly agreed to them.

The services provided by Björn Strenge do not constitute legal advice and do not replace it. All spoken and written information serves solely to give detailed information about employment and migration options in Germany – including recognition procedures, visa procedures and the associated administrative steps. You are always advised to consult the official sources and the competent authorities for current and legally binding information.

Changes to these general terms and conditions are communicated to the client by email. If the client does not object within four weeks of receiving the notification, the changes are deemed to have been accepted.

2. Scope of the consultation assignment

The scope of the consultation contract is governed by the individual offer or by the service booked (for example a consultation, a consultation package or a digital product). Björn Strenge is entitled to have the consultation assignment carried out in whole or in part by qualified cooperation partners.

3. Offer and conclusion of the consultation contract

The consultation services of Björn Strenge are subject to change and without obligation. A contract only comes into existence when Björn Strenge submits an individual offer and the client expressly accepts it (by email), or when the client schedules and/or pays for a service. The same applies to additions and ancillary agreements.

4. Obligations of the client

The client ensures that Björn Strenge receives in good time all information and documents required to fulfil and carry out the consultation assignment, and that he is informed of all matters and circumstances that are relevant to carrying out the assignment.

If the client is a consumer within the meaning of § 13 BGB (German Civil Code) and the contract is concluded exclusively via the website, by email, by telephone or through a messenger service (distance contract), the client has a statutory right of withdrawal of 14 days. The client may therefore withdraw from the contract within this period without giving reasons. The full information, the deadlines and the model withdrawal form can be found in the Right of Withdrawal.

The right of withdrawal expires early if Björn Strenge has provided the consultation in full and only began to perform it after the client had expressly requested that performance begin before the withdrawal period expired, and the client had at the same time confirmed that they lose their right of withdrawal once the contract has been fully performed (§ 356 Abs. 4 BGB). Björn Strenge obtains this express request and this confirmation when a consultation appointment is booked, and stores them together with the booking.

If a consumer withdraws after the consultation has already begun at their express request but has not yet been provided in full, they must pay proportionate compensation for the part of the service provided up to the withdrawal (§ 357 Abs. 8 BGB). The remaining amount is refunded.

If the right of withdrawal has expired as set out above, or does not exist – for example because the client is not a consumer – no refund is given once a consultation has been paid for, because Björn Strenge begins the preparation immediately after payment is received. An exception applies only if Björn Strenge establishes that legal advice is required before the agreed meeting or the booked package. In that case the consultation is cancelled and the amount paid is refunded.

Consultation appointments can be rescheduled free of charge up to 8 hours before the appointment – either using the link in the confirmation email or by email to info@migranten-hilfe.de.

Björn Strenge and his staff make every effort to be punctual and expect the same from clients. They wait up to 15 minutes before a client is deemed not to have attended and the appointment is ended without a refund.

5. Payment

a) The fee for the consultation services is based on the rates stated in the individual offer or on the website.

b) All invoices are due for payment before the consultation service is provided.

c) When booking a consultation appointment through the website, the client can choose card payment through the payment service provider SumUp or payment via PayPal and settle the amount immediately. If the client chooses to pay with a voucher, Björn Strenge first checks the enquiry and then sends the payment details by email.

d) The consultation appointment is binding as soon as payment has been received.

6. Liability

All documents and all individual consultations are prepared to the best of our knowledge and belief and with the greatest care. However, Björn Strenge accepts no liability for the advice given, for the migration and career strategies proposed, or for the specific content of applications. Responsibility for these lies solely with the client. Björn Strenge can guarantee neither a successful visa application nor a successful job placement.

Björn Strenge acts in accordance with the generally recognised principles of professional practice and is liable for damages within the framework of the statutory provisions only where intent or gross negligence can be proven against him.

7. Duty of confidentiality

Björn Strenge and the partners he commissions undertake to maintain secrecy about all matters of which they become aware in connection with their work for the client. This is done in accordance with the provisions of data protection law.

8. Final provisions

These general terms and conditions are governed by the law of the Federal Republic of Germany and are to be interpreted in accordance with German law. The client and Björn Strenge will endeavour to settle disputes by negotiation. If no agreement is reached, the place of performance and the exclusive place of jurisdiction is Jever, Germany.

If Björn Strenge fails to enforce a right or a provision of these general terms and conditions, this does not count as a waiver of that right. Should a provision be invalid or unenforceable, the remaining provisions remain unaffected and continue to apply.
